The probe of the suspended Chairman of the Economic and Financial Crimes Commission, EFCC, Ibrahim Magu has continued to generate both controversy and public attention since it started.

The presidential panel is headed by Justice Ayo Salami and has been digging into the activities of Magu as the suspended EFCC Boss has been accused of some corrupt practices which need to be probed. However, Magu has kicked against some things which have to do with the handling of the probe. According to him, the panel have done some things which were biased against him and he found them somehow shocking as well. Magu spoke through his lawyer, Wahab Shittu. This article focuses on the five major things Magu said through his lawyer as he kicks against the manner his probe is was handled.

First, Magu through his lawyer kicked against media report that the panel had submitted interim report to President Muhammadu Buhari where it recommended that the President should sack the suspended EFCC Boss and prosecute him. According to Magu's lawyer, this latest media report should be ignored. Magu's lawyer added that there was a similar report on another issue, but the Chairman of the panel told them to ignore it when they reached him on the issue.

So, Shittu added that this latest media report should be ignored as well because it does not reflect the reality on ground.

Second, Magu through his lawyer stated that he was yet to present his defense as proceedings were still ongoing. Magu has made it clear that he has witnesses lined up in readiness for his defense. But, he has not been given the opportunity to make his defense. He also pointed out that he has not been served copy of the allegations against him despite making demands for that to be done.

Thirdly, Magu through his lawyer revealed that the Attorney-General of the Federation and Minister of Justice, Abubakar Malami has not shown up to testify to support his allegations against him. Recall that it was Malami's memo triggered the proceedings against Magu. So, Malami has a role to play as well in backing up his claims.

Magu through his counsel pointed out that Malami has not done his part in this respect.

Fourthly, Magu also alleged that he was excluded from the initial stages of his process. According to Magu's lawyer, Shittu, Magu was excluded from the initial stages of the proceeding and witnesses testified against Magu in his absence. Moreover, Shittu added that Magu's counsel(s) were not allowed to cross-examine the witnesses that testified against their client as expected until not long ago. He added that the witnesses were not sworn on oath as expected. Shittu also said that Magu after his suspension has no access to official documents and other information necessary for his defence. According to him, that would somehow affect his client in preparing for his defence.

Moreover, Magu through his lawyer Shittu alleged that cases pending before superior courts of records such as Federal High Court, Court of Appeal and the Supreme Court are being reviewed in the proceedings. Shittu argued that they believe that this development is subjudice and unhealthy for our jurisprudence.

Normally, subjudice cases are allowed until they are decided because any attempt to review them may be seen as a biased move. This is because no one knows how the court(s) may eventually decide the cases. Shittu added that since the proceeding is still ongoing and Magu yet to defend himself, the suggestion that an interim report had been submitted to Buhari came to them as a shocking development.

From the above points, Shittu who spoke on behalf of Magu who he represents, made it clear that there are a lot of controversies against the report that Buhari should sack the embattled EFCC Boss. Moreover, Magu is alleging bias in the whole process. Among other things, he is kicking against the handling of his probe. It is left to be seen if his kicks will yield any result or whether the panel's alleged report will be acted upon by Buhari.
